Terms and Conditions

1. Scope of application

For contracts for participation in events of the provider Ginger Up / Toskar („provider“), the regulations on the provider‘s registration form and the following general terms and conditions apply.

 

2. Terms and conditions of participation

2.1. The registration is valid only for the person named as the participant on the registration form. If this person is unable to attend the event in person, the right to participate shall expire and the participation must be cancelled in accordance with section 5. It is not possible to transfer the right to participate.

2.2. The participant agrees to a licensing partnership for one year beginning with the completion of the introductory seminar. The trademark licence agreement signed by the parties between the licensor Ginger Up and the licensee applies.

2.3. According to the brand licence agreement, the participant is obliged to offer only the spiritual treatment in the sense of the initiator Pjotr Elkunoviz under the licensed brand. Furthermore, the participant undertakes not to pass on the Divine Straightening, Spiritual Realignment training as a seminar or initiation. Not even under another name.

 

3. Confirmation of participation

3.1. The number of participants for each seminar is limited. Written registrations will be considered and processed in the order in which they are received. However, the Provider reserves the right to reject a registration without stating reasons. A contract for participation in the provider‘s events is only concluded after the provider has confirmed the registration to the participant in writing. The participant will receive further information with the confirmation of participation.

3.2. Amendments and/or supplements to the contract must be made in writing. Verbal agreements are only valid if confirmed in writing by the provider. The same applies to the written form requirement.

3.3 The provider is entitled to cancel an event for economic or organisational reasons. In this case, the provider will refund the participation fees already paid as well as the per diem meal allowance. No further claims can be derived from this. Any cancellation or rebooking costs for means of transport or overnight accommodation booked by the participant will not be reimbursed by the provider.

 

4. Payment terms

The seminar fee is to be paid within 14 days of receipt of the invoice, but no later than 4 weeks before the start of the seminar. Payment is to be made by transferring the amount to the account specified on the invoice. The timeliness of the payment is determined by the date of receipt of the payment on this account.

 

If the payment is not received in time, the provider is entitled to exclude the participant from the respective seminar or to assign another date for participation, subject to receipt of payment. The participant will be notified of this by email if necessary. In the event of final exclusion from participation, a late incoming participation fee will be refunded immediately to an account to be specified by the participant. Any costs of the refund are to be borne by the participant and will be deducted from the refund.

 

5. Cancellation

Participation can be cancelled up to two weeks before the start of the seminar. A processing fee of EUR 150 will be charged. In the event of cancellation up to one week before the start of the event, half of the participation fee will be due, and after that the full participation fee will be due, unless a substitute participant from the same company is provided. Rebookings will be treated as cancellations.

 

Cancellations must be made in writing to the provider. The effective date for the validity of the cancellation is the date of receipt of the notification by the provider (inbox or e-mail receipt).

 

6. Liability

The Provider shall only be fully liable for intent and gross negligence. The Provider shall only be liable for simple negligence if it does not concern a breach of essential contractual obligations. Essential contractual obligations are those which make the execution of the contract possible in the first place. No liability is accepted if events lead to a delayed start of the event or to the complete cancellation of an event due to force majeure. The provider accepts no liability for consequential damage resulting from any incorrect and/or incomplete content of the lectures and/or event documentation. The above exclusions and limitations of liability shall apply to the same extent in favour of the organs, legal representatives, employees and other vicarious agents of the supplier. The exclusions and limitations of liability in this section 6 do not apply to the Provider‘s liability for wilful misconduct, for guaranteed characteristics, for injury to life, health or under the Product Liability Act.

 

7. Obligations of the participants

Participation in the seminar is voluntary and independent. The participant assumes full responsibility for his/her actions inside and outside the course. It is expressly pointed out that the course offer does not replace medical treatment. Physical or mental impairments, illnesses or other disorders of the participant must be reported to the course provider or instructor immediately before the start of the course. This also applies if the participant is in a condition requiring treatment, is not in full physical or mental health or is under the influence of medication.

 

The participant is obliged to compensate the Provider for any damage he/she may have caused or the participant shall indemnify the Provider, the course instructor and his/ her agents from all claims by third parties, in particular from any costs of legal defence and prosecution, upon first request.

 

8. Seminar documentation

8.1 Seminar documentation is created exclusively for the seminar participants and is intended for them only. All contents, logos, images, graphics, sound documents, video sequences and curative agents are protected under the copyright laws.

8.2 The contents of the seminars/seminar documentation may not be reproduced, stored and/or passed on to third parties or published in any way.

 

9. Changes to the course of the event

The Provider reserves the right to replace or cancel individual lectures within the framework of an event, provided that this does not affect the general character of the event.

 

10. Provider and place of jurisdiction

The provider of the online seminars is Ginger Up, 50678 Cologne, Germany. For our seminars, only the seminar conditions apply, the place of jurisdiction is Munich, Germany.

 

11. Severability Clause

The invalidity of individual provisions shall not affect the validity of the remaining Terms & Conditions.

 

Status of the Terms & Conditions: January 2023

Divine Straightening® / Spiritual Realignment® License Partnership

After successful completion of the Initiation Seminar, the use of Divine Straightening®, Spiritual Realignment® and related trademarks is permitted in accordance with the license agreement.


To preserve the uniqueness and spiritual power of this healing method, the terms “Divine Straightening” and “Spiritual Realignment” are registered European, UK and US trademarks.


They represent a clearly defined and distinctive healing method on the spiritual level.


Use of the trademarks and membership in the Light Network Healers-United is free of charge during the first year.


From the second year, participation includes an annual membership fee of EUR 180. Trademark use remains subject to the Terms & Conditions of the license agreement with Toskar / Ginger Up.
